All employees deserve to work in an environment free from sexual harassment. If you have been victimized by such conduct at work, the Law Offices of James Jean-Francois, P.A. can advise you of your rights, help you correct the situation or, if necessary, sue your employer on your behalf.
Sexual harassment is unwelcome sexual conduct of any kind in the workplace that threatens or offends an employee. There are two types of sexual harassment:
Sexual harassment is not limited to a male victimizing a woman or a more senior employee victimizing a less senior one. It includes any conduct of the type described above, regardless of the gender, sexual preference or role of either the perpetrator or the victim. When you seek my help, I will draw on my extensive knowledge of employment law to determine if you have been the victim of sexual harassment, advise you what to do about it and represent you in a lawsuit if warranted.
If you think you might be the victim of sexual harassment, the first step is to document the harassing behavior. You should preserve any offensive emails, letters, photographs, bulletin board postings or other tangible evidence and keep them in a safe place. You should make a detailed record of any verbal or physical incidents of harassment that you cannot document directly. If you have been subjected to or threatened with an adverse job action, compile evidence that the action is undeserved, such as your performance evaluations and work product, as soon as the harassment starts and before you complain about it.
When you do complain to your employer, make sure to keep a record of that fact and what the employer does or does not do about the complaint. I will help you prepare the documentation you will need if the problem is not corrected or you face retaliation. If your employer fails to stop and correct the consequences of the sexual harassment, I will help you file a complaint with the U.S. Equal Employment Opportunity Commission or the Florida Commission on Human Relations and represent you in court.
